The AMLA has launched a public consultation on draft Regulatory Technical Standards (RTS) that introduce a harmonised methodology for assessing the money laundering and terrorist financing risk of obliged entities in the non-financial sector.
The proposed RTS sets out how national supervisors should establish the risk profile of supervised entities using a common set of risk indicators, or 'data points'. The aim is to ensure that similar businesses are assessed consistently across all EU Member States, enabling supervisors to apply a more risk-based and proportionate approach to supervision.
The standards are particularly relevant for law firms. The methodology will determine which information legal practices will need to collect, maintain and submit annually to their national supervisory authority in the future. Different sectors, such as legal services, estate agencies and gambling operators, will be assessed using sector-specific data points, while smaller entities will be subject to fewer reporting requirements to help reduce the administrative burden.
AMLA is seeking feedback from businesses, professionals and supervisory authorities until 27 September 2026. A public hearing on the draft standards will take place on 10 September 2026, and, once adopted, the methodology is expected to apply from 31 December 2028.
